–DEFINITIONS AND WYOMING LAW–
“You,” “Customer,” “Buyer,” and/or “Purchaser” refers to the person or entity who books the order.
“I”, “Baker,” “Ten Sleep Sweets,” and/or “Decorator” refers to the person or entity selling and fulfilling the order.
“Event Date” refers to the date that the order is requested to be ready for the customer.
“Delivery Date” refers to the date that the order is to exchange hands from Ten Sleep Sweets to Customer.
Per WY HB0129 and W.S. 11-49-101 through 11-49-103, also known as The Food Freedom Act, products provided by Ten Sleep Sweets are homemade which means this food is prepared in a private home kitchen that is not licensed, inspected, or regulated.
I am not legally allowed to ship my products nor can I sell across the Wyoming state line, so please don’t bother asking. I consider myself extremely lucky to live in a state that allows people to make their own decisions about what they eat, and to let business owners make a living without intense over-regulation.
Ten Sleep Sweets reserves the right to refuse orders. That said, I have no moral objections to any designs other than those that are intended to cause harm.
–THE BASICS–
There will come a time when a customer will attempt (without even knowing) to over-manage a project. I will gently advise if you are edging into this territory, and we can either discuss how to curb that going forward, or we will part ways on a good note.
I might question the validity of a customer’s order. There are far too many scammers out there, so please be prepared for some validating questions before your order is accepted.
Ten Sleep Sweets will communicate with ONLY ONE POINT OF CONTACT per order, and all communication must be in writing. If a phone call is deemed absolutely necessary by at least one party, all details will be followed-up in writing via email by Ten Sleep Sweets shortly after the call. If Customer does not notify Ten Sleep Sweets of any inaccuracies included in the email within twenty-four (24) hours of the email being sent, all details on the follow-up email will be considered accurate. Phone call communication will not be accepted for any orders under $300. These calls create extra work and time.
AI Inspo Pictures: ChatGPT and other AI apps, while helpful in the creative process, tend to give people the idea that these images can always be turned into cookies. While we can communicate likes/dislikes based on an AI image, it is important that you understand digital art is vastly different from cookie art, and you should not expect digital art quality in a cookie.
Design and Colors: Inspo pictures are exactly that: inspiration. I prefer to design based on ideas and inspiration provided by the customer.
Colors will be matched as closely as possible to your requests, but there is no guarantee that colors will match your inspo picture perfectly. PLEASE NOTE: Dark colors take a substantial amount of dye, will stain your mouth when you eat them, and can also affect the taste. Please consider lighter colors as an alternative if you plan to take pictures at your event. I often use cocoa powder in my icing. If you have an allergy or aversion to chocolate, it is your responsibility to let me know before you order.
Your business logo: If you absolutely need an exact design or your business logo, I might just recommend that you choose an Etsy cookier who will use printed images or print directly on a cookie. At this point in my cookie art journey, I prefer to create designs with my hands rather than using digital images. That said, some logos can be recreated with icing. Just reach out, show me your logo, and I’ll let you know if it’s one that I can recreate without printed media. Most logos are understandably created with bold colors in order to stand out. Please see my policies and warnings about colors in the above paragraph. **If you are not a representative of the company whose logo you are requesting, I will not be providing cookies for you with that logo.**
–PAYMENT AND DEPOSIT POLICY–
Payment is accepted through the Square payment system. An invoice with a link for payment will be emailed or texted to you, and you can pay by debit card, credit card, or ACH. Cash is accepted only by return customers in good standing, and must be pre-approved. Checks are accepted only under certain circumstances, and must be cleared before I begin working on your order. Checks require a $1.00 surcharge. I prefer to not deal with checks.
Until Customer receives a payment confirmation email, the order is NOT on the books and is not considered confirmed. I book quickly, so it’s important that you pay as soon as you receive your invoice in order to secure your date. When we discuss your order, I will let you know when to expect the invoice. My point-of-sale system (Square) automatically sends reminders for payment. If after 2 reminders you have not paid your invoice, your order will be canceled. NO RUSH ORDER (orders within 10 days of event) will be accepted without full payment made on the same day of the order.
Cookie orders under $150 and all other items of any amount:
- Quotes are valid for three (3) days.
- All orders must be paid in full to get on the books. Your order is not considered confirmed until your invoice is paid in full.
- 50% of your invoiced amount is considered a non-refundable deposit.
- If Customer cancels prior to two weeks before the event date, Customer’s full deposit will be retained by Ten Sleep Sweets. 50% of the retained deposit may be used toward a future order with Ten Sleep Sweets, to be redeemed within 6 months.
- If Customer cancels within (inside of) two weeks of event date, Customer forfeits the entire non-refundable deposit.
COOKIE ORDERS OVER $150, and ALL OTHER ITEMS OF ANY AMOUNT:
- Quotes are valid for five (5) days.
- If Customer cancels order prior to four weeks before the event date, and customer has paid in full, 50% of Customer’s payment will be refunded, and 50% will be retained by Ten Sleep Sweets. 50% of the retained deposit funds may be used toward a future order with Ten Sleep Sweets. Must be redeemed within six (6) months of cancelation date.
- If Customer cancels order within (inside of) four weeks of event date, and customer has paid in full, 50% of Customer’s payment will be refunded. No portion of the deposit may be used for a future order.
**If Ten Sleep Sweets cannot fulfill Customer’s order, the entire amount paid by Customer will be refunded.**
–FOOD CARE–
Care of products: Handling and care instructions will be provided. Failure by Customer to follow the instructions might result in a less-than-desirable product. My recipe is best when cookies are frozen until ready for use.
Please do not send someone to get your cookies who doesn’t understand the money you put into them or the time I put into them. This is delicate food. Please be sure it is treated as such.
–CRITICAL INFORMATION ABOUT FOOD ALLERGIES–
I am well educated in food safety, and I take it very seriously.
Orders that you will be taking to a school:
It is my understanding that when you bring treats to the school, you are supposed to be sure to accommodate students with allergies. Please contact the school to verify whether or not any of the students in your child’s class have food allergies BEFORE you place your order. I make every effort to remain in contact with parents of students at Ten Sleep with food allergies to 1) help avoid allergic reactions, 2) provide treats specifically for them without bringing attention to their allergies, and 3) help provide assurance to the parent(s) of the child(ren) with allergies that I am aware of the specific allergy. I, however, have no way of knowing whether or not every one of them is on my Food Allergies List. I have to rely on your due diligence in helping keep the children safe for possible allergens.
Gluten allergies:
I WILL NOT provide desserts for celiacs as I work predominately with flour, and the weightlessness of flour lends itself to taking flight through the air. As a Cottage Foods home baker I do not have a second area in which to prepare items without risk of cross contamination from wheat.
Peanut/tree nut allergies:
I do have peanut butter in the home, in its own cupboard. I do not bake with peanuts or tree nuts, so the nuts will not touch any of my baking materials or surfaces. In addition, all prep areas and baking materials and surfaces are thoroughly cleaned and sanitized both before and after use. Because peanut butter and other potential nut-related allergens are in the house, however, I cannot guarantee a 100% nut-free environment. If you choose to purchase desserts from me and you know a person with peanut/tree nut allergies will be in the vicinity when you serve them, please be sure to let me know when you order so we can discuss and take extra precautions. I do not use almond extract in my baking, as it has been known to cause reactions in people with nut and tree nut allergies.
Dairy allergies:
I do have dairy items in my kitchen and refrigerator. I keep non-dairy preparation and baking materials separate from my regular baking supplies and, as standard operating procedure, thoroughly clean and sanitize all materials and surfaces both before and after preparation and baking.
I do not provide gluten-alternative, egg-alternative, or sugar-alternative items at this time.
–pICKUP AND/OR DELIVERY–
Pickup/delivery/exchange. Based on both Ten Sleep Sweets’ schedule and yours, we will decide on a pickup/delivery/exchange time. Items can be picked up at Ten Sleep Sweets by appointment only. VERY IMPORTANT: Please do not expect delivery unless that arrangement is made when I confirm your order. 99% of my customers pick up their order from my location.
If I agree to deliver, any delivery made outside of the town of Ten Sleep will depend on the mileage, will always be in a public space, and will require a delivery fee. If you are flexible in your schedule, I can sometimes deliver to Worland during a grocery shopping trip without charging a delivery fee, but please be sure to be on time. If you miss your 20-minute meeting timeframe/window, you will need to pick up your order in Ten Sleep at a later time, and your delivery fee (if already charged) will not be refunded. The Wyoming Food Freedom Act does not allow me to ship my products.
I understand things happen. If you are not able to pick up your order, please contact me as soon as you know you won’t be able to make it. I might be able to hold your order, but space is limited, and my schedule often works around the freezer space I have available. Please respect my schedule to help me keep things on track. Without prior agreement, cookies and desserts that haven’t been picked-up within 1 (one) week of the agreed upon event date will be considered abandoned and will be donated with no refund to Customer.
If we have arranged for you (or someone in your place) to pick up your food at Ten Sleep Sweets, please follow the instructions given to you.
Please be prepared to properly transport your order. I already wrote this above, but it’s important to remember: This is food. If you send someone in your place to pick up your order, please make sure they also know that putting your cookies/desserts in the back of a steamy hot car during a shopping or hiking trip is not the correct way to handle these items, nor is throwing them on the floor of a car with the dogs, or in the bed of the truck in freezing or scorching hot weather. Many of my cookies contain some fragile elements so please understand that once the cookies leave my hands, the same care must be taken after the exchange. I am not liable for what happens to your order after it leaves my care, so I cannot stress enough how important it is to properly transport and care for your items until you serve them.
–dONATIONS PROVIDED BY TEN SLEEP SWEETS–
“Donated Dozens” Gift Certificates: For “Donated Dozens” Gift Certificates donated by Ten Sleep Sweets, the following conditions apply:
- The “Donated Dozens” Gift Certificate is limited to one (1) order.
- The order must be placed no later than the “Order by” date provided on the “Donated Dozens” Gift Certificate.
- Event/pickup date must be no later than 30 days after “Order by” date listed on the gift certificate.
- May not be used toward edible images nor any other special order item(s).
- Each dozen cookies is limited to 2 designs and 5 colors.
- May be used toward a larger order. The dollar amount to be used toward the larger order will be calculated based on the price per dozen for standard cookies at the time of ordering.
- Gift certificate is not redeemable for cash.
- Orders made with “Donated Dozens” Gift Certificates are not eligible for refunds.
–ODDS ‘N ENDS–
Rush orders: A rush order is considered any order placed within 10 days of event. Not all rush orders can be accommodated. NO RUSH ORDER (orders within 10 days of event) will be accepted without full payment made on the same day of the order.
Decorative packaging: In order to keep the prices down and reduce wasteful practices, I have decided to forego the fancy packaging, except for an occasional special. I can give you approximate dimensions of the final product should you wish to box the desserts yourself.
The moment food is accepted by the Customer or the person sent by the Customer to retrieve the food, the Customer acknowledges that the order is satisfied.
If Customer intends to dispute the quality of the item(s), Customer must contact Ten Sleep Sweets immediately (the same day of the event), and MUST RETURN AT LEAST 95% of the whole product to Ten Sleep Sweets, at Customer’s expense and travel, in edible condition within one (1) day of event date in order to negotiate a refund. My recipes are tried and true and taste tested.
Special orders: Edible images, toppers, some special cutters, etc., must be paid for in full as soon as Ten Sleep Sweets orders them, no exceptions. Should you choose to cancel your order (see cancellation policy), those items become yours.
Pictures: I reserve the right to post photos/pictures of all items I sell. If your cookies are a surprise or a gift for someone, please be sure to let me know so I can wait until after you have gifted them to post the photos.
Sneak Previews: Sneak previews will typically not be sent to Customer. The design will be based upon inspo pictures provided by Customer and based upon communication between Customer and Ten Sleep Sweets. The Sneak Preview is not a time to make changes.
Personalized Cookies: If you want your cookies personalized, I can do simple handwriting at no extra charge. You must have the list of names to me at least 7 days prior to your event date. If you want a more professional font for the names, the cost will be an additional $ .50 per cookie.
All of our communication will be based on the understanding that you have read and understand my policies.
