My Policies

–DEFINITIONS AND WYOMING LAW–

“You,” “Customer,” “Buyer,” and/or “Purchaser” refers to the person or entity who books the order.

“I”, “Baker,” “Ten Sleep Sweets,” and/or “Decorator” refers to the person or entity selling and fulfilling the order.

“Event Date” refers to the date that the order is requested to be ready for the customer.

“Delivery Date” refers to the date that the order is to exchange hands from Ten Sleep Sweets to Customer.

Per WY HB0129 and W.S. 11-49-101 through 11-49-103, also known as The Food Freedom Act, products provided by Ten Sleep Sweets are homemade which means this food is prepared in a private home kitchen that is not licensed, inspected, or regulated.

I am not legally allowed to ship my products nor can I sell across the Wyoming state line, so please don’t bother asking. I consider myself extremely lucky to live in a state that allows people to make their own decisions about what they eat, and to let business owners make a living without intense over-regulation. 

Ten Sleep Sweets reserves the right to refuse orders. That said, I have no moral objections to any designs.

There will come a time when a customer will attempt (without even knowing) to over manage a project. I will gently advise if you are edging into this territory, and we can either discuss how to curb that going forward, or we will part ways on a good note.

I might question the validity of a customer’s order. There are far too many scammers out there, so please be prepared for some validating questions before your order is accepted.

I cannot provide character cookies. Copyright law exists for a reason, and I’m certainly not rich enough to take on Disney. I can, however, create designs that will complement the character/movie/television show you are decorating your event with.

Design and Colors: Inspo pictures are exactly that: inspiration. I prefer to design based on ideas and inspiration provided by the customer. If you absolutely need an exact design or your business logo, you might be required to purchase a stencil (if one exists) or edible images.

Colors will be matched as closely as possible to your requests, but there is no guarantee that colors will match your inspo picture perfectly. PLEASE NOTE: Dark colors take a substantial amount of dye and will stain your mouth when you eat them. Please consider lighter colors as an alternative if you plan to take pictures at your event.

–PAYMENT AND DEPOSIT POLICY–

Payment is accepted through the Square payment system. An invoice with a link for payment will be emailed or texted to you, and you can pay by debit or credit card. If you prefer to pay via ACH, please let me know before I send your invoice. Cash is accepted only by return customers in good standing, and must be pre-approved. Checks are accepted ONLY under certain circumstances, and will require a $1.00 surcharge. I prefer to not deal with checks.

Until Customer receives a payment confirmation email, the order is NOT on the books and is not considered confirmed. 

Ten Sleep Sweets will communicate with ONLY ONE POINT OF CONTACT per order, and all communication must be in writing. If a phone call is deemed absolutely necessary by at least one party, all details will be followed-up in writing via email by Ten Sleep Sweets shortly after the call. If Customer does not notify Ten Sleep Sweets of any inaccuracies included in the email within twenty-four (24) hours of the email being sent, all details on the follow-up email will be considered accurate.

Rush orders may require an additional fee. Not all rush orders can be accommodated.

Cookie orders under $250 and all other items of any amount:

1. All orders must be paid in full to get on the books. Your order is not considered confirmed until your invoice is paid in full.

2. 50% of your invoiced amount is considered a non-refundable deposit.

3. If Customer cancels prior to two weeks before the event date, Customer’s full deposit will be retained by Ten Sleep Sweets. 50% of the retained deposit may be used toward a future order with Ten Sleep Sweets, to be redeemed within 6 months. Non transferrable.

4. If Customer cancels within (inside of) two weeks of event date, Customer forfeits the entire non-refundable deposit.

COOKIE ORDERS OVER $250, and ALL OTHER ITEMS OF ANY AMOUNT:

1. If Customer cancels order prior to four weeks before the event date, and customer has paid in full, 50% of Customer’s payment will be refunded, and 50% will be retained by Ten Sleep Sweets. 50% of the retained deposit funds may be used toward a future order with Ten Sleep Sweets. Must be redeemed within six (6) months of cancelation date. Non transferrable.

2. If Customer cancels order within (inside of) four weeks of event date, and customer has paid in full, 50% of Customer’s payment will be refunded. No portion of the deposit may be used for a future order. Non transferrable.

**If Ten Sleep Sweets cannot fulfill Customer’s order, the entire amount paid by Customer will be refunded.**

–FOOD CARE–

Care of products: Handling and care instructions will be provided. Failure by Customer to follow the instructions might result in a less-than-desirable product. 

–CRITICAL INFORMATION ABOUT FOOD ALLERGIES–

I am well educated in food safety, and I take it very seriously.

Gluten allergies:

I WILL NOT provide desserts for celiacs as I work predominately with flour, and the weightlessness of flour lends itself to taking flight through the air. As a Cottage Foods home baker I do not have a second area in which to prepare items without risk of cross contamination from wheat. 

Peanut/tree nut allergies:

I do have peanut butter in the home, in its own cupboard. I do not bake with peanuts or tree nuts, so the nuts will not touch any of my baking materials or surfaces. In addition, all prep areas and baking materials and surfaces are thoroughly cleaned and sanitized both before and after use. Because peanut butter and other potential nut-related allergens are in the house, however, I cannot guarantee a 100% nut-free environment. If you choose to purchase desserts from me and you know a person with peanut/tree nut allergies will be in the vicinity when you serve them, please be sure to let me know when you order so we can discuss and take extra precautions. I do not use almond extract in my baking, as it has been known to cause reactions in people with nut and tree nut allergies.

Dairy allergies:

I do have dairy items in my kitchen and refrigerator. I keep non-dairy preparation and baking materials separate from my regular baking supplies and, as standard operating procedure, thoroughly clean and sanitize all materials and surfaces both before and after preparation and baking. 

I do not provide gluten-alternative or sugar-alternative items at this time.

–ODDS ‘N ENDS–

Decorative packaging: In order to keep the prices down and reduce wasteful practices, I have decided to forego the fancy packaging, except for an occasional special. I can give you approximate dimensions of the final product should you wish to box the desserts yourself.

Pickup/delivery/exchange. Based on both Ten Sleep Sweets’ schedule and yours, we will decide on a pickup/delivery/exchange time. Items can be picked up at Ten Sleep Sweets by appointment only. Delivery anywhere on Highway 16 within the town of Ten Sleep is free. Delivery outside of the town of Ten Sleep will depend on the mileage, but will always be in a public space. (If you are flexible in your schedule, I can often deliver to Worland during a grocery shopping trip, but please be sure to be on time.) If you miss your 20-minute meeting timeframe/window, you will need to pick up your order in Ten Sleep at a later time, and your delivery fee (if already charged) will not be refunded. The Wyoming Food Freedom Act does not allow me to ship my products.

If we have arranged for you (or someone in your place) to pick up your food at Ten Sleep Sweets, please follow the instructions given to you. These might sometimes include remaining in your car when conditions are icy, snowy, or slippery.

Please be prepared to properly transport food items. If you send someone in your place to pickup the food, please provide to them all of the instructions and information I provide you about proper care and transport.

Special orders: Edible images, toppers, special cutters, etc., must be paid for in full as soon as Ten Sleep Sweets orders them, no exceptions. Should you choose to cancel your order (see cancellation policy), those items become yours. 

Pictures: I reserve the right to post photos/pictures of all items I sell. If your cookies are a surprise or a gift for someone, please be sure to let me know so I can wait until after you have gifted them to post the photos.

Final proofs will typically not be sent to Customer. The design will be based upon inspo pictures provided by Customer, or it will be based upon communication between Customer and Ten Sleep Sweets.

The moment food is accepted by the Customer or the person sent by the Customer to retrieve the food, the Customer acknowledges that the order is satisfied.

If Customer intends to dispute the quality of the item(s), Customer must contact Ten Sleep Sweets immediately (the same day of the event), and MUST RETURN AT LEAST 95% of the whole product to Ten Sleep Sweets, at Customer’s expense and travel, in edible condition within one (1) day of event date in order to negotiate a refund. My recipes are tried and true and taste tested.
